1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of Asher AI API (the "Service"), operated by Ho Wei Yang ("Asher", "we", "us"), an individually-operated service based in Singapore. By purchasing a quota pack or using the Service, you agree to be bound by these Terms.
2. Description of service
Asher AI API is a usage-based reseller service that provides prepaid access to third-party AI language models via an OpenAI-compatible API endpoint. We are an independent reseller and are not affiliated with, endorsed by, or officially partnered with any underlying model provider.
3. Plans and payment
- All plans are prepaid quota packs (Starter $5, Standard $10, Pro $20) purchased through our payment processor, Creem.
- Purchased quota is valid for 30 days from the date of purchase and does not roll over or renew automatically.
- Prices are listed in USD and may change at any time for future purchases; changes do not affect quota already purchased.
4. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Generate content that is illegal, abusive, or infringes on the rights of others
- Attempt to circumvent rate limits, quota controls, or security measures
- Resell or redistribute access to the Service without our prior written consent
- Reverse-engineer, scrape, or interfere with the Service's infrastructure
We reserve the right to suspend or terminate access for any account found to be in violation of these terms, without refund of remaining quota where the violation involves fraud, abuse, or illegal use.
5. Usage limits
To keep the Service reliable for all customers, requests are subject to per-account rate limits (requests per minute), tiered according to your plan. Usage is strictly capped to your prepaid quota; once quota is exhausted, further requests will be rejected until additional quota is purchased.
6. Refund policy
If you experience a verified technical issue that prevents you from using your purchased quota, you may request a refund within 7 days of the original purchase date by contacting asherhoe@gmail.com. Refund requests are reviewed manually. Quota that has already been consumed is non-refundable; unused, unconsumed quota affected by a verified technical issue is eligible for a full or prorated refund at our discretion. We do not offer refunds for change of mind, unused quota after the 7-day window, or violations of these Terms.
7. Service availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service depends in part on third-party infrastructure and upstream model providers outside our direct control, and availability may be affected by factors beyond our reasonable control.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that outputs generated by underlying AI models will be accurate, complete, or suitable for any particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
10. Changes to the Service or these Terms
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time; material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of Singapore, without regard to conflict of law principles.
